What is unfair dismissal?

If you’ve been fired from your job then you might have a claim for unfair dismissal – not only will you normally lose out on salary and benefits if you’ve been dismissed from your job, but the loss of your job can also have uncomfortable, long-term effects on your life. In serious cases, and depending on your circumstances, you might never work again.

An unfair dismissal occurs if an employee who has the necessary continuous period of service (currently two years, with limited exceptions) is dismissed from their job by their employer. If the employee is dismissed from their job in these circumstances the employer must:

  1. Show that there is a ‘potentially fair’ reason for the employee’s dismissal (currently these are: misconduct, incapability (medical- or performance-related); redundancy; illegality; and ‘Some Other Substantial Reason’);
  2. Show that the procedure has been fair; and
  3. Show that the dismissal was within ‘the range of reasonable responses’ in the circumstances
